Terms of Service

Effective October 1, 2026

These Terms of Service ("Terms") govern your use of wcsoffroad.com (the "Site") and any purchase you make from WCS Offroad ("WCS Offroad," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who can use the Site

You must be at least 18 years old, or the age of majority where you live, to create an account or place an order. We sell and ship only to addresses in the United States. We may refuse service, cancel orders, or close accounts at our discretion, including for suspected fraud or misuse.

2. Accounts

You are responsible for keeping your login details confidential and for all activity under your account. Please give us accurate, current information and tell us promptly if you believe your account has been used without permission.

Dealer accounts. Dealer and wholesale pricing is offered only to approved businesses and is confidential. Dealers must provide accurate business and resale-certificate information and keep it current. We may change dealer pricing or revoke dealer status at any time.

3. Products and fitment information

We work to describe our products and their vehicle fitment accurately, but fitment data, descriptions, photos and specifications are provided as a guide. Vehicles vary by trim, options, production date and prior modifications. Please confirm that a part fits your vehicle before installing it. Product photos may show accessories, finishes or vehicles that are not included, and colors may look different on your screen.

If we discover an error in a product listing, including its price, we may correct it and cancel any affected order, with a full refund of anything you have paid.

4. Orders, pricing and availability

Your order is an offer to buy. We accept it when we ship the item or confirm acceptance in writing. Prices are in U.S. dollars and may change without notice; the price that applies is the one shown when you place your order.

Backorders and lead times. Some items are made to order or shipped from our suppliers and are listed with an estimated lead time (for example, "ships in 20–25 days"). Lead times are estimates. If we cannot ship within the time stated, we will tell you and give you the choice to wait for the new date or cancel for a full refund. If we have not stated a time, we will ship within 30 days or contact you with the same choice.

We may limit quantities and may cancel orders that appear to be placed by resellers without a dealer account, contain errors, or cannot be fulfilled.

5. Payment and taxes

Payments are processed by our payment provider, Stripe. Your card details are sent directly to Stripe and are never stored on our servers. By placing an order you authorize us to charge the payment method you provide for the order total, including shipping and applicable sales tax. Sales tax is calculated based on your shipping address.

6. Shipping and delivery

We ship to addresses in the United States. Oversize items such as hoods, bumpers and fenders may ship by freight carrier, and freight delivery may not be available to some areas, including Alaska and Hawaii. Shipping options and costs are shown at checkout.

Title and risk of loss pass to you when your order is delivered to the shipping address you provide. For freight deliveries, please inspect the shipment before signing and note any visible damage on the delivery receipt, then contact us within 48 hours with photos. Damage that is not noted at delivery can be very difficult to recover from the carrier.

7. Returns and refunds

Returns, exchanges and refunds are handled under our Shipping & Returns policy, which forms part of these Terms. Parts that have been installed, modified, painted, or used are generally not returnable unless they are defective.

8. Installation, use and legal compliance

Many of our products are aftermarket performance and off-road parts. We strongly recommend installation by a qualified professional. You are responsible for installing and using products correctly and safely, following the manufacturer's instructions.

  • Some products are designed for off-road use only and may not be legal for use on public roads, including certain lighting and exhaust components.
  • You are responsible for making sure that your vehicle, as modified, complies with all federal, state and local laws and regulations, including emissions, noise, lighting, equipment and inspection requirements.
  • Modifying a vehicle can affect its handling, safety, emissions, fuel economy, insurance coverage and manufacturer warranty.

9. Warranties

Many products carry a warranty from their manufacturer. Where a product includes a manufacturer's warranty, that warranty applies and we will help you make a claim. Any warranty we offer ourselves will be stated on the product page or in writing.

Except for the warranties stated above, and to the fullest extent permitted by law, products and the Site are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow these exclusions, so they may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, WCS Offroad will not be liable for any indirect, incidental, special, consequential or punitive damages, including installation or removal labor, towing, vehicle downtime, rental costs, lost profits, or damage arising from improper installation, misuse or off-road use. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that product.

Nothing in these Terms limits liability that cannot be limited under applicable law, including for personal injury caused by our negligence.

11. Your responsibilities

You agree to indemnify and hold harmless WCS Offroad from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of products, your breach of these Terms, or your violation of any law or the rights of others.

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping or copying it in bulk, submitting false orders, or using it for any unlawful purpose.

12. Intellectual property

The Site and its content, including text, photos, graphics, logos and the WCS Offroad name, are owned by us or our licensors and are protected by law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission. Product and vehicle names are the trademarks of their respective owners and are used only to describe fitment.

13. Privacy and communications

Our Privacy Policy explains how we collect and use your information. We send emails about your orders and account. We send marketing emails only if you opt in, and you can unsubscribe at any time using the link in any marketing email.

14. Disputes and governing law

If you have a concern, please contact us first; most issues can be resolved quickly and informally. If we cannot resolve a dispute within 30 days, either party may bring a claim. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any claim must be brought in the state or federal courts located in San Diego County, California, except that either party may bring an eligible claim in small claims court.

15. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Changes do not apply to orders placed before the update.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and us about the Site and your purchases.
